Kentucky Attorney General Files Transvaginal Mesh Suit Against Johnson & Johnson

Kentucky Attorney General Andy Beshear has announced a major lawsuit against Johnson & Johnson, claiming that the company failed to alert female consumers of the dangers associated with its transvaginal mesh (TVM) products. The lawsuit punctuates a growing concern for Kentucky women who have been hurt by TVM, several of which whose claims are currently being handled by Bahe Cook Cantley & Nefzger PLC.

As the Courier-Journal reports, Attorney General’s Office’s press release alleges that more than 15,000 Kentucky women have experienced adverse side effects to their TVM implantation. Speaking to the press, Beshear said Johnson & Johnson had told doctors that their product had been “FDA approved,” but it had only been FDA cleared, which does not represent the same evaluation process. The suit calls for millions of dollars in damages, but there is no mention of compensation to individual patients affected by the product.

“The way this company clearly chose profits over people is outrageous,” Beshear told reporters. TVM is a surgical implant used to treat a number of different pelvic issues in women, but has shown to promote unintended side effects, such as chronic pain and loss of sexual function.

Growing Nationwide Concern
This new lawsuit is not the first major legal action taken against manufacturers of TVM in 2016. The attorney generals of both California and Washington filed similar lawsuits against Johnson & Johnson this past spring.
